Website owned and operated by Hemas Pharmaceuticals (Pvt) Ltd, the Distributor of Hair Buddy products.

By accessing or using this Website and/or placing an order for Hair Buddy products, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these Terms, please do not use this website or place an order.

1.Definitions & Interpretation

In these Terms:

• “Website” means the online store operated by Hemas Pharmaceuticals for Hair Buddy.
• “Customer”, “you”, “your” means the person placing an order via the Website.
• “Order” means a purchase placed for a Hair Buddy product.
• “Product” means the Hair Buddy Botanical Fusion Mask.

2.Eligibility & Use of the Website

• The Website is intended for use by individuals located in Sri Lanka.
• By placing an Order, you confirm that you are at least 18 years old.
• You are responsible for providing accurate and complete information (name, delivery address, contact details) when making an Order.
• You may need your own account to use the Website, and you may be required to be logged in to the account. If you create an account, you are solely responsible for maintaining the confidentiality of your account details and password and for restricting access to your computer or mobile device. You agree to accept responsibility for all activities that occur under your account.
• The Products sold are intended for personal use only. You agree not to sell or resell any Products purchased from this Website without the express prior written consent of Hemas Pharmaceuticals (Private) Limited.

3.Product Information, Pricing & Availability

• Product descriptions, images and other content on the Website are for general information only. Minor variations in colour, packaging and labelling may occur.
• All prices are in Sri Lankan Rupees (LKR), inclusive of applicable taxes unless stated otherwise. Hemas reserves the right to change prices or discontinue Products at any time without prior notice.
• Orders are subject to availability. Hemas may cancel or refuse any Order at its discretion, including due to product unavailability, pricing errors or fraudulent activity, and will notify you accordingly.

4.Order Acceptance & Payment

• Once you submit an Order and payment is confirmed, Hemas will send an Order Confirmation to your registered email or via WhatsApp.
• Please note that the Order is confirmed only after payment is successfully processed.
• Hemas reserves the right to cancel or modify any Order before dispatch.

5.Cancellation Policy

You may request cancellation of your Order within six (6) hours of placing the Order. To request cancellation, contact us via WhatsApp at +94 76 465 7876 with your Order number. If your Order has already been dispatched, cancellation cannot be accepted.

• • 5.2.Refunds for Cancelled Orders

If your cancellation request is accepted, a refund will be made to your original payment method within 3-10 working days. Shipping or handling fees are non-refundable.

6.Shipping Policy

    • Colombo and suburbs: 1-3 working days
    • Other areas of Sri Lanka: 1-5 working days
    • External factors such as public holidays, courier delays or weather may lengthen delivery time.

Shipping charges will be displayed at checkout. Free delivery may apply during promotional periods.

7.Returns & Refunds

Due to the nature of personal care products, we do not accept returns or refund requests for products that have been opened or used, unless the product is defective or damaged upon receipt.

The Products are sold “as is” and are subject only to the warranties and guarantees, if any, provided directly by the Manufacturer of the Products (identified in Section 14). Any warranty claim or request for repair, replacement, or refund based on product quality or defect must be initiated directly with the Manufacturer in accordance with their stated warranty policy.Limitation of Liability

    To the fullest extent permissible under Sri Lankan law, under no circumstances shall Hemas Pharmaceuticals (Private) Limited (as Distributor and Website Operator) ), its officers, directors, employees, parent company, subsidiaries or affiliated companies, or the owner of the Hair Buddy brand and its Products, be liable for any indirect, incidental, special, consequential or punitive damages, such as, but not limited to, loss of revenue, loss of anticipated profits, goodwill, diminution of value, business interruption costs, or any other intangible arising out of, related to, caused by, or resulting in any way from:

    • The use of, or the inability to use, the Website or the services offered therein;
    • Modifications of or removal of any portion of the Website or the content offered therein;
    • These Terms & Conditions;
    • The accuracy, timeliness, performance, completeness, or suitability of any content or the services for any particular purpose;
    • Defects, errors, inaccuracies, or omissions in the Website’s content or the services;
    • Damage from any security breach or any other security intrusion, or any virus, bugs, other malicious software or harmful components, tampering, interruption, delay in operation or transmission, computer line or network failure, or any other technical or other malfunction.

You acknowledge that Hemas Pharmaceuticals (Private) Limited acts exclusively as the distributor and seller of the Products, which are formulated, manufactured, and packaged by a separate third-party brand owner, Oproma Cosmetics Pvt Ltd To the maximum extent permissible under Sri Lankan law, Hemas Pharmaceuticals (Private) Limited disclaims any and all liability and warranties for claims related to product safety, inherent composition, manufacturing defects, allergic reactions, or physical injury arising directly from the Product’s design, ingredients, or application. All such claims and inquiries regarding the Product’s quality or inherent safety must be directed exclusively to the manufacturer of the Product.

9.Product Usage Disclaimer & Health Warning

• You acknowledge and agree that you use the Product at your own risk. Hemas Pharmaceuticals (Private) Limited is not liable for any adverse reactions, allergies, injury, or damage resulting from the use or misuse of the Product.
• It is your responsibility to carefully read the Product ingredients and usage instructions provided on the Product label and the Website before use.
• If you have known allergies or sensitivities, you must perform a patch test before full application.
• By purchasing and using the Product, you confirm that you have checked the ingredients against any known allergies and accept the risk.

10.Intellectual Property

All content on the Website including the design, text, graphics, logos, brand names, images (excluding the Hair Buddy brand elements), is the property of Hemas Pharmaceuticals (Private) Limited or its licensors and is protected by copyright, trademark and other intellectual property laws. You are granted a limited licence to access and use the Website for personal, non-commercial use only.

You acknowledge that the name of Product “Hair Buddy”, logo, packaging design, product formulation details, and related trademarks are the exclusive property of the Hair Buddy Brand Manufacturer (as identified in Section 14) and are used by Hemas Pharmaceuticals (Private) Limited under license for the purpose of distribution and sale.

• 10.3.User Generated Content
  • By posting, uploading, or submitting content (including reviews, comments, photos, and videos) to the Website or any Hair Buddy social media channel, you grant Hemas Pharmaceuticals (Private) Limited a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media.
  • You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; and that use of the content you supply does not violate this policy.

11.Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any dispute arising from or related to these Terms or your use of the Website shall first be attempted to be resolved amicably between you and Hemas. Failing which, the dispute may be submitted to a court of competent jurisdiction in Sri Lanka.

12.Changes to These Terms

Hemas reserves the right to amend or modify these Terms at any time in its sole discretion. Continued use of the Website after such amendments constitutes your acceptance of the revised Terms. You should regularly review this page to stay informed of any updates.
